Have any other lab owners out there told their dentists about the 2.3% excise tax? Do you think it's something we should tell our dentists yet? Wondering also who of you out there will "eat" the tax, and who will pass it on?

Assuming it actually happens, I'm totally passing it along as an invoice line item. I would say nothing about it until after the election and/or Thanksgiving.

To my understanding, the FDA ruling does not mandate your charge the 2.3% Excise Medical Devise Tax (EMDT), however, it does mandate that you pay it.
Many of my clients are split 50/50, half will be passing the tax on to their clients while others will absorb it. I guess it depends on how much you are charging for the dental prosthesis. -

I have yet to see a valid argument for absorbing the tax (without a price increase) regardless of the lab's fee level. Its a TAX to the dentist, not an expense. For those who are lower priced, charging a line item is best because it allows the published price of restorations to stay lower. For anyone else, it shows the dentist that the lab is compliant with the law and increases their perceived integrity....See more

I spoke to a study club of about 100 dentists last night and when I brought this up, there was a collective sigh in the room. Then a complete sidebar took place. They had no idea this was coming. Nick is right. We have to pay the Tax, but how we decide to collect it is up to us. Glidewell told me they will just eat it, while other plan on adding a line item to their invoice. I have already talked to one of my clients about this tax. He has an in office Cerec system & Patterson did not tell him word one about how this tax will affect him. I will wait a little longer before telling my other dentist clients. If we must pay into this new tax, I as a small lab, will have to pass it on to my clients. Joe, The only items that will be taxed are appliances that have a FDA code number. Sleep appliances, implant abutments and off shore resterations have a FDA code. Crowns, bridges, dentures and so on will not be taxed. Several of our materials used to fabricate dental restorations have a FDA code and will effect us on our price of alloy, acrylic, Zirconia and on and on. Not good news but better than...See more

About the Excise Tax, an IRS agent told me to read IRS Regulation 4191(a). She said it is about 41 pages long. She also said there is an uncertainty and there may be an announcement in 2013 about it.

From what I hear, the excise tax goes into effect January 1, 2013. I hope the IRS makes it clear to us what effect it will have on dental labs soon.

Is anyone pressing Emax with an Optimal Autopress furnace, and if so, do you have any suggestions on pressing programs. Also, does anyone out there have suggestions on pressing furnaces expressly for Emax (other than the Ivoclar ovens - cost prohibitive).

we've always used Ivoclar ovens & presses to make over 30,000 e.max over the past couple of years. Its nice to not have to come up with "workarounds" or solutions to problems that do not exist with the Ivoclar equipment. It also helps to have the right equipment to handle the next generation of ingots that will be released soon.
